Terms of Service

These Terms of Service explain the basic conditions for requesting a digital art commission from me (Ørigo). They are based on public artist commission agreement templates and real commission terms used by independent digital artists, then tailored for my services.

Acceptance of commissions

Submitting a request form or contacting me does not guarantee that the commission will be accepted. A commission is accepted only when I clearly confirm the request and consider it achievable with my current art skills.

I reserve the right to decline or cancel a request for any reason, including unclear scope, unsuitable subject matter, poor communication, scheduling limits, suspected abuse, or requests that are too complex.

Client information and references

As my client, you are responsible for providing accurate contact information, clear commission details, and references needed to complete the work. You MUST have the right to use any character, design, reference image, brand, or other material supplied for the commission.

If possible, I highly recommend making sure you have the owner's permission before requesting a character that is not yours in your request, even for a gift.

Scope and creative process

The final artwork will be created in my style. References, pose ideas, mood, outfit details, and character notes may guide the work, but I retain creative interpretation - Consequently, I do not trace any reference you will provide.

As specified in the "How It Works" section, you have the right to ask for any major or minor modifications during the sketch phase, but you are limited in major changes after this step, or you will be subject to extra fees.

Keep in mind that I do not provide fixed deadlines because I want to do my best - please be patient !

Payment

Payment terms will be confirmed before the commission starts if needed. I personally require full payment after sketch validation before continuing to work on your commission.

I only use PayPal as a payment method, but I may accept cash if you live in my country and/or if I can meet you in person.

Refunds and cancellations

As stated earlier, I may cancel a request for any justified reason. If I have to do it, I will mostly cancel the commission before payment (before validating the sketch), so we can avoid the refund process.

However, I reserve the right to cancel a commission after payment if a personal issue prevents me from continuing your request ; in this case you will be refunded.

I also reserve the right to cancel a commission after payment if communication between the client and me becomes disrespectful, or if the client stops responding about their request ; in this case I will refund 50% of the overall commission price.

Note that I do NOT refund the commission if you decide to cancel your request after payment for any reason. I do NOT refund finished commissions as well.

Delivery

After finishing your request, I will send you a digital copy of the completed artwork. I will send you a transparent PNG version of the artwork for free if requested.

There is no fixed delivery deadline, since I'm quite slow to give of my best, so please, be patient !

Usage rights

Unless otherwise agreed in writing, commissions are for personal use only. You may save the artwork, share it on personal social media with credit, use it as an avatar, profile image, banner, wallpaper, or print it for personal display.

You are not allowed to claim authorship, remove credit, resell the artwork, use it for merchandise, advertising, business assets, paid content, or other commercial purposes without a separate written commercial license.

Commercial use requires my explicit permission. The client receiving commercial usage rights will be charged an additional fee.

Copyright and portfolio use

I retain copyright and ownership of the final artwork unless a written rights transfer says otherwise. I am likely to display completed work, cropped previews, or process material in portfolios, social media, commission sheets, and promotional materials unless privacy or delayed posting is agreed in writing.

Prohibited uses

My art may not be used for NFTs, cryptocurrency projects, blockchain tokens, machine-learning datasets, AI model training, automated image generation systems, hateful activity, harassment, impersonation, or illegal purposes.

You may not edit, trace, heavily modify, or commission another person to alter the artwork in a way that misrepresents the original work unless I give you permission to do so.

Changes to these terms

These Terms may be updated from time to time. The terms in effect when a commission is accepted will generally apply to that commission unless we agree otherwise.
